List of control (supervision) types applying risk-based approach is expanded

By the Russian Government Resolution of February 16, 2017 #197 the List of state control types applying risk-based approach is supplemented with federal government oversight of compliance with labor legislation and other normative legal acts containing employment and labor laws.

It will be remembered that earlier changes were made to the Federal Law of December 26, 2008 #294-FZ “On the Protection of the Rights of Legal Entities and Individual Entrepreneurs in the Exercise of State Control (Supervision) and Municipal Control” which stipulates, that from January 1, 2018 in providing certain types of state control (supervision) the state control (supervision) bodies shall apply risk-based approach.

For the purpose of stage-by-stage development of transition mechanism to risk-based model at certain types of state control, the list of control types whereby this approach will be applied until January 1, 2018 was approved by the Government Order of August 17, 2016 #806.

Now this list is supplemented with federal government oversight of compliance with labor legislation and other normative legal acts containing employment and labor laws.

In addition, the document amends the Regulation on state federal supervision over the observance of the labor code and other legal acts, containing labor regulations

(approved by the Government Order of September 1, 2012 #875).

The incorporate changes specify:

- scope of officials authorized to take decisions on assignment of certain risk category to employers’ activities and change previously assigned risk category;

- risk categories;

- criteria of certain risk category assignment to employers’ activities

- scheduled inspections, depending on employers’ activities assigned risk category

The introduction of risk-based approach will improve efficiency of control and supervision means in the field of work with optimal use of material, financial and human resources of federal state control bodies and reduce administrative burden on subjects of entrepreneurial activities.
